An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona, establishing the City Council as the Board of Adjustments for the City of Maricopa. Discussion and Action.
AGENDA ITEM DESCRIPTION
As allowed by A.R.S. §9-462.06(A), Council recently approved a code change that allows a hearing officer to provide relief from the terms of the zoning code by variance applications and to hear and decide appeals from decisions of the zoning administrator. However, pursuant to A.R.S. §9-462.06(A), the right of appeal from the decision of a hearing officer to the board of adjustment shall be preserved. The legislative body can be established as the board of adjustment. Because the City does not have many requests for a variance or appeals from decisions of the zoning administrator,the Board of Adjustment meets infrequently. With the approved delegation to the hearing officer, the Board of Adjustment will now likely meet even less. Therefore, in the interest of efficiency, council can establish themselves as the Board of Adjustment to hear appeals from the decision of the hearing officer.
STAFF RECOMMENDATION
Staff recommends approval of this Ordinance to establish City Council as the Board of Adjustment for the City of Maricopa.
