TITLE
The City Council shall discuss and take action on approving a Fire Protection Services Agreement with the South Maricopa Fire Association, an Arizona nonprofit corporation, and its Declarants regarding fire protection services to be provided by the City of Maricopa for property within the Association. AGENDA ITEM DESCRIPTION
The property owners within the South Maricopa Fire Association previously entered into a Declaration of Covenants, Conditions and Restrictions for the purpose of, among other things, arranging for the provision of fire protection services to the service area in exchange for certain assessments, fees and charges. The City agrees to provide fire protection services to the service area in exchange for collecting certain fees and assessments including, but not limited to, the equivalent of $400 per month for every lot which has received a building permit and $100 per month for every lot which has been platted but has not received a permit. Fire protection services includes fire suppression, prevention and inspection but does not include ambulance, or emergency medical services.
The Association has also agreed to sale the City real property to use to construct a fire station once the Development Amount, as funded by the City's Initial Deposit, the Association's Initial Deposit and ongoing Association Impact Fees, reaches $2,500,000.00. The Association Impact Fees are substantially similar to the City's current Development Impact Fees for fire which allows the City to control the fire services in this area with funds it is not able to collect without this agreement
In addition, in exchange for providing fire protection services, several owners within the association agreed to enter into a Pre-Annexation Agreement with the City that allows annexation of their property as soon as such property is statutorily eligible. Such agreements will support the growth of the City into the southern planning area.
