TITLE

The Mayor and City Council shall discuss and possibly take action on approving a second, six (6) month extension of final plat approval case # SUB19-09, Apex Condominium Plat. Discussion and Action.

 

AGENDA ITEM DESCRIPTION

This request is for an approval of a second, six (6) month extension of the approved final plat for Apex Condominium Plat. The project received approval from City Council on November 19, 2019. The project received a one (1) time six (6) month extension on October 27, 2020.  Due to extenuating circumstances beyond the Applicant's control (detailed in Exhibits A and B), the Applicant is requesting a second, six (6) month extension. Per the city code, Sec. 14-4-6 (G) of the Subdivision Code,  the project was allotted 12 months from the date of approval to submit required approved Engineering Plans and Reports, Utility approval plans, and required financial assurances for public improvements (streets, sidewalks, landscaping, etc.). Due to infrastructure improvement delays beyond the control of the developer, the applicant requested and received an extension as allowed per the recently adopted code, which allows for a one (1) time, six (6) month extension of final plat approval. The City Council has the authority to grant an extension beyond what the Code dictates.

STAFF RECOMMENDATION

Staff recommends approval of a second, six (6) month extension request for SUB19-09 Apex Condominium Plat, subject to the conditions of approval stated in the staff report.
