TITLE
An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona, amending Sections 8.20.010, 8.20.020 and 8.20.040 of the Maricopa City Code related to nuisances within the City of Maricopa and amending sections 9.05.010 and 9.30.010 of the Maricopa City Code related to offenses within the City of Maricopa providing for severability and the effective date thereof. Discussion and Action.

AGENDA ITEM DESCRIPTION
Soon after the incorporation of the City, on June 1, 2004, the City Council adopted Resolution 04-12 Maricopa City Code and Chapter 10 Offenses (which has sense been amended and renumbered), by designating certain areas within the city limits as “Special Rural Property” and “Special Development Property” “Special Property Designation Map,” and through the designation, these areas were exempt from nuisance abatement, code violations, property maintenance violations and penalties for violations.

Over the years, some of the properties in these areas have been voluntarily improved, and some still are in dilapidated conditions or despair. The city is unable to assist in the cleanup and abatement because of the protection from the decade-old regulation in the City Code. In order to improve the quality of life and resolve the life safety issues within these neighborhoods, the Maricopa City Code provisions related to such nuisances and offenses will need to be amended and the above-mentioned special clause removed for the equitable and fair application of the Code citywide.

The purpose of the proposed amendments to Titles 8 Nuisances and Title 9 Offenses (see attached) is to provide clarity, add new terms/ definitions, and remove/delete provisions that are not required or in conflict with other city codes and regulations. The proposed amendments are necessary to prevent harm to life, property, and the environment. These requirements are based on a practical balance between public safety, nuisance abatement, and outdated regulations.
