TITLE

A Resolution of the Mayor and City Council of the City of Maricopa, Arizona, approving and adopting a Uniform Video Service License Agreement and Application to comply with Arizona Revised Statutes (ARS) Title 9, Chapter 13 relating to uniform regulation and licensing of video and cable service providers.  Discussion and Action.

 

AGENDA ITEM DESCRIPTION

In 2018, the Arizona State Legislature approved and the Governor signed into law Senate Bill 1140, which amended Title 9 of the Arizona Revised Statutes by adding Chapter 13 relating to video and cable services.  SB1140 establishes the need for Uniform Video Service License Agreements, forms, provisions, and fees.

 

Each local government is required to adopt a Uniform Video Service License Agreement and a standard form Application on or before July 1, 2019.

 

The City has adapted a model Uniform Video Service License Agreement that was developed by a working group of Arizona municipalities in cooperation with industry stakeholders and the League of Towns and Cities.  The model license agreement sets forth the rights-of-way use requirements and authorizes the installation, operation, and maintenance of video services. 

 

The City will also need to adopt changes to City Code, as it relates to video services, by January 1, 2020.  SB1140 gives the City some discretion on provisions that can be added to City Code.  Those proposed changes will be brought in front of the Council before the end of the calendar year.

Staff recommends approval of the Resolution approving and adopting a Uniform Video Service License Agreement and Application.
