TITLE

A Resolution of the Mayor and City Council of the City of Maricopa, Arizona, vacating and abandoning, with compensationin the form of an easement, Papago Street and a portion of McDavid Road generally located north of Edwards Avenue, South of the Union Pacific Railroad tracks, and West of State Route 347 within the City of Maricopa.  Discussion and Action. 

 

AGENDA ITEM DESCRIPTION

This is a request to abandon 0.3062 acre of Papago Street and McDavid Road right-of-way north of the McDavid-Edwards curve and south of the Union Pacific Railraod.  Although the right-of-way exists on a recorded plat, the roadway has never physically existed nor has plans to be improved as a roadway.  The two adjacent parcels would obtain ownership.  A property owner is dedicating to the City for public use, a public access easement for the planned benefit of a nonmotorized ramp and bridge to assist pedestrians and cyclists safely cross the Union Pacific Railroad. On condition of approval is recommened within the attached memo.

 

The request was made by the property owner to for the abandonment.  The City is required to receive compensation for conveying public property to a private property owner and the exchange of property, as in this case, is allowed per A.R.S. §28-7203. 

 

Staff has conducted research for conflicts that would result from the abandonment, to find none.  Staff has researched the request from the Transportation and Planning perspectives and does not see a need for segments of right-of-way requested for abandonment.

 

All of the required steps to abandon right-of-way as required in Title 28 of the Arizona State Statutes have been followed.

STAFF RECOMMENDATION

Staff recommends approval with condition of the Resolution to abandon the portions of Papago Street and McDavid Road.
