TITLE

The Mayor and City Council shall discuss and possibly take action on approval of a Temporary Drainage Easement for improvements to Smith-Enke Road from Chase Drive to White and Parker Road.  Discussion and Action.

 

AGENDA ITEM DESCRIPTION

The City previously entered a Development and Settlement Agreement with Metro Red-1, LLC, wherein the City agreed to use Road Fees and Development Fees to construct and install the half-street improvements on the north side of Smith-Enke Road between Chase Drive and White and Parker Road.  The proposed roadway improvements will require the installation of a temporary retention basin on the north side of Smith-Enke Road, which will require a temporary drainage easement.  When the vacant property immediately to the north of this segment of Smith-Enke Road develops, the developer will remove the temporary retention basin and route the roadway drainage to a permanent retention basin within the development.  The temporary drainage easement will expire and terminate thirty (30) days after another drainage solution is accepted by the City, unless otherwise terminated sooner by an agreement in writing signed by both the City and Metro Red-1, LLC or their successors or assigns.

Staff recommends approval of the Temporary Drainage Easement for the half-street improvements to Smith-Enke Road.
