TITLE
The Mayor and City Council shall discuss and possibly take action to enter into an Option and Land Lease Agreement with T-Mobile West LLC for a wireless antenna on City owned property at Pacana Park located at 18800 N. Porter Road. Discussion and Action.
AGENDA ITEM DESCRIPTION
Staff has negotiated a land lease agreement with T-Mobile West, LLC for the placement of a wireless antenna in place of an existing light pole at Pacana Park owned by the City at 18800 N. Porter Road. T-Mobile West is proposing to replace an existing 70-foot high ball field light pole at Pacana Park with a new light pole with field lights and related appurtenances. The Antenna Facilities shall be constructed, maintained and operated at T-Mobile's expense. The general terms of the lease are as follows:
1. T-Mobile will pay the City $1,000 per month during the initial five-year term of the agreement.
2. The Initial Term shall automatically renew for five (5) successive renewal termsof five (5) years each.
3. Upon the expiration of the final renewal term, the Term shall automatically extend for up to nine (9) successive one (1) year periods.
4. During the Term, monthly Rent shall be adjusted on each anniversary of the Commencement Date to an amount equal to two (2) percent of the Rent in effect immediately prior to the adjustment date.
The City currently has two land lease agreements with Verizon Wireless, LLC for cellular towers on City owned properties generally located on the SW corner of SR 347 and Bowlin Road and at Pacana Park located at 18800 N. Porter Road.
STAFF RECOMMENDATION
Staff recommends entering into the Option and Land Lease Agreement with T-Mobile West, LLC.
