TITLE
An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona, amending Article 1-8 of the Maricopa City Code regarding the penalty for code violations, amending Article II of Chapter 9 regarding penalties for property maintenance violations and amending Chapter 10 regarding penalties for violation thereof and providing for severability and the effective date thereof. Discussion and Action.

AGENDA ITEM DESCRIPTION
These revisions are necessary to bring all current codes relating to enforcement of City Codes into one area for Code Enforcement. This update will allow Code Enforcement to use a singular City Code provision for penalties. Currently, Code Enforcement may have to cite several different areas of the City Code for a single violation.

The new Code Enforcement Policy, which will be approved by the City Manager, will consist of four separate areas:

1. Standard Code Enforcement

This section will address the policy, complaints, and how these are to be handled. Staff determines the best action plan that will involve either notices of violations or citations.

2. Recidivist Persons/Properties

This section deals with repeat offenders and addresses how to stop those habitual offenders.

3. Inspection/Enforcement

This section addresses “Properties in the Immediate Area, which are an Obvious Detriment or Blight”, which will allow staff to address violations on nearby properties or additional violations on the complaint property without an additional complaint being made.

4. Interdepartmental/Interagency Cooperation

This section outlines the cooperative nature of the code enforcement process and will provide an outline for working with other departments or agencies to produce the best outcome for the City and the Citizens.
