AGENDA ITEM DESCRIPTION

The Mayor and City Council approved Contract CON 14-50 on December 2, 2014, in which Wilson & Company was to conduct an Update to the Maricopa Regional Transportation Plan.  The contract term was December 2, 2014 to June 30, 2016, with a not to exceed amount of $577,580.  On June 21, 2016, the Mayor and City Council approved a First Amendment, thereby extending the contract term to December 31, 2016 so that the complete Public Information process of the Val Vista and Anderson Planning Corridors could be performed, with no additional funding requested with the First Amendment.  The project remains within budget. 

 

This Second Amendment includes the time extension to June 30, 2017 and the addition of two new elements: (1)  A Truck Route Study, and (2) the addition of Land Use Legal Consultation Services.  Both new tasks and services are proposed to be paid out of existing budgeted funds and no new funds are requested.  Specifically, the Truck Route Study was approved in the Capital Improvement Project Budget in FY16/17 in the amount of $50,000.  The Land Use Legal Consultation is proposed to be paid out of residual from the General Plan project, in the amount of $20,000. Wilson & Company will conduct the Truck Route Study, and Bill Simms, a recognized expert attorney in Land Use, will provide legal counsel as a subcontractor to Wilson & Company under the existing contract, CON 14-50.  The extension to June 30, 2017 keeps the underlying contract CON 14-50 active in order to accommodate the new elements.

 

The Truck Route Study is a critical element in Maricopa’s Circulation Plan due to the extreme effect that large heavy trucks have on traffic and the damage these trucks cause to Maricopa roadways.  This study was attempted during Phase I of the Area Transportation Plan.  However, the complexity of the task prevented  full and effective study due to funding limitations.  Funding is now available in the CIP approved budget mentioned previously. 

 

Land Use Legal Consultation is necessary due to various stages of land entitlement which already exist in the path of proposed roadway planning corridors.  These planning corridors are critical to Maricopa’s  regional connectivity and internal circulation, in part due to the limitations on our ability to improve SR347.  However, existing Development Agreements and  complex land entitlements mandate that we have legal guidance in how to progress with preservation of Right Of Way in a legal manner.  Understanding of these concepts are key to successful implementation of Planning Maricopa, the City's General Plan.  Bill Simms will provide the legal counsel in these complex areas.  We have coordinated this proposal with our Maricopa City Attorney, with no objection.

STAFF RECOMMENDATION

Staff recommends that the Mayor and City Council approve the Second Amendment to contract CON 14-50, Wilson & Company, which extends the contract term to June 30, 2017, adds a Truck Route Study and Land Use Legal Consultation Service.
