TITLE
The Mayor and City Council shall discuss and possibly take action to approve a Consent Agreement for the Transfer of County Right-of-Way between the City of Maricopa and Pinal County for the purpose of transferring portions of Anderson Road and Peters and Nall Road from Pinal County to the City of Maricopa. Discussion and Action.
 
AGENDA ITEM DESCRIPTION
On August 7, 2012, the City of Maricopa approved the annexation of the Bunger property (Annexation 11-01) which lies east of the Ak-Chin Community and south of Peters and Nall Road. This Annexation included the West half of Anderson Road as it borders the annexation. At the same time, the City of Maricopa approved an Intergovernmental Agreement between the City of Maricopa and the Ak-Chin Community.  Section 5 of this IGA states that, "The Parties agree that the City intends to gain control of the Anderson Easement and Peters and Nall Easement from Pinal County".  Approval of this Transfer Agreement fulfills the City of Maricopa's commitment, as agreed upon in the August 7, 2012 IGA with the Ak- Chin Community. Please refer to Green colored roadway indicated in attachment MAP A. This item was discussed in E-Session on October 7, 2014.  If passed by Council, this agreement will next be brought before the Pinal County Board of Supervisors for approval.
 
STAFF RECOMMENDATION
Staff recommends the approval of the Consent Agreement for the Transfer of County Right-of-Way.
