TITLE
An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona, pertaining to the National Flood Insurance Program, adopting by reference revised Flood Insurance Study and Flood Insurance Rate Maps, and Floodplain Management Regulations; repealing Chapter 15 of the City Code regarding Flood Damage Prevention; providing for repeal of conflicting ordinances; providing for severability; and providing penalties.Discussion and Action.

AGENDA ITEM DESCRIPTION
On December 20, 2005, the City of Maricopa approved Ordinance 05-15 adopting new floodplain management regulations and establishing the City Engineer as the Floodplain Manager. Previously, the City had delegated responsibility of floodplain management to Pinal County Flood Control District. The ordinance was created in anticipation of pursuing independent floodplain management. Although the City has the option to adopt and enforce its own floodplain regulations per A.R.S. § 48-3610, the City has chosen to continue under the Pinal County Flood Control District’s county-wide floodplain regulatory program.

The City will receive new floodplain mapping this year. Part of that process involves a Federal Emergency Management Agency (FEMA) review of the City’s floodplain management ordinance prior to the maps becoming effective. Because the adopted ordinance does not reflect the City’s delegation of responsibility to Pinal County, it will not be compliant with State and Federal regulations.

This action will adopt a compliant floodplain management ordinance that meets the minimum State and Federal requirements and continues delegation of floodplain management to Pinal County Flood Control District. This ordinance will also adopt the Pinal County Floodplain Management Ordinance, dated August 16, 2006, and all subsequent amendments and/or revisions, as the legal basis for implementing floodplain management in Maricopa.
