TITLE
The Mayor and Council shall discuss and possibly take action to approve a Recycled Water User Agreement with Global Water Resources for the lake at Pacana Park. Discussion and Action.

AGENDA ITEM DESCRIPTION
Global Water Resources (aka Palo Verde Utility Company) provides recycled water to the City owned lake at Pacana Park. Recycled water is subject to a variety of federal, state and local regulations that are necessary to protect the safety of the public and the integrity of the potable(drinking water) water supply system. As part of the regulation requirements, Reuse permits from theArizona Department of Environmental Qualtiy (ADEQ) are required for all end users and are subject to the provisions of these Reuse permits. Global Water, through their wastewater utility Palo Verde Utility Company (PVUC), obtained Type 2 Reuse permits for each individual end user (each HOA that has recycled water lakes) at the time of development becuase at that time the actual end users were not established in order to obtain the permit themselves. These Type 2 permits are now expiring; therefore Global Water, for matters of liability, efficiency and resources, has obtained an area wide Type 3 Reuse permit from (ADEQ). Obtaining the Type 3 permit prevents each end user from having to obtain their own Type 2 permit through ADEQ. Without either this agreement or the City obtaining a Type 2 permit from ADEQ, Global Water can not legally deliver recycled water to the lake at Pacana Park.
The majority of the language contained in the agreement coincide with the regulatory requirements of direct reuse of recycled water. The agreement also contains provisions on the Utility to End User arrangements; examples being the non-guarantee of continual availability of recycled water, monitoring and reporting, etc.
