TITLE
The Mayor and City Council shall discuss and possibly take action to approve a Drainage Easement Agreement with Capstone Resdev I, LLC for a portion of the drainage channel located west of Stonegate Road and on the north side of Maricopa-Casa Grande Highway.Discussion and Action.
 
AGENDA ITEM DESCRIPTION
The City entered into a development agreement with Shea Commercial for The Wells development in 2007.
 
As part of the development agreement, the City agreed to pay back certain agreed upon public improvements and to accept those improvements into the City's maintenance system.  
 
As part of the agreed upon improvements, Shea Commercial was to widen Maricopa Casa Grande Highway and relocate the adjacent drainage channel.  The relocation was completed with The Wells development and the Right of Way for the raodway was donated at that time.  
 
In order for the highway to be widened through the full frontage of the The Wells development, it was decided to transition the channel outside of Shea Commercial's property line (west of Stonegate Rd).  For this to be completed, the City required that Shea Commercial obtain the necessary easements to complete the tranition.  
 
This agreement allows the City to have an easement for the purposes of constructing, using, maintaining, operating, altering, repairing, replacing, reconstructing, inspecting and removing the drainage facility within the easement.
 
STAFF RECOMMENDATION
Staff recommends approval of the Drainage Easement Agreement.
