TITLE
The City Council shall discuss and possibly take action on selecting a method by which to fill the vacancy on the City Council, approve an application and to open up the recruitment from October 17, 2012 to October 31, 2012. Discussion and Action.
AGENDA ITEM DESCRIPTION
On October 4, 2012, Councilmember Alan Marchione resigned his position as Councilmember of the City of Maricopa effective immediately. Section 2-13 of the Maricopa City Code dictates how vacancies on the City Council shall be filled.
Sec. 2-13. Vacancies in Council
The council shall fill any vacancy in council by one of the following methods, at the option of council:
(a) By appointment for the unexpired term; or
(b) By appointment until the next regularly scheduled council election if the vacancy
occurs more than thirty (30) days before the nomination petition deadline. The
councilmember appointed shall be a qualified elector in the city and shall meet the
qualifications set forth in Section 2-51 of this Code. A councilmember elected pursuant to
this paragraph shall be elected to serve for the unexpired term.
Councilmember Alan Marchione's term expires in the fall of 2014. Our next regularly scheduled council election will also take place in the fall of 2014 pursuant to ARS §16-204(E) which states that all candidate elections shall be held in the fall of even numbered years beginning in 2014. This was changed from our previous spring elections of even numbered years after HB2826 passed earlier this year.
STAFF RECOMMENDATION
Staff recommends that the City Council direct staff on the application and appointment process to fill the vacancy on the Maricopa City Council. Staff also recommends that Council recruit from October 17, 2012 to October 31, 2012.
