TITLE
The Mayor and City Council shall discuss and possibly take action to approve entering into a Stipulated Final Judgment in condemnation action CV 2013-00629 against Maricopa Land Company, LLC, a Michigan limited liability company, and authorizing the City Manager to execute such Stipulated Final Judgment in a form substantially similar to that attached to this agenda item. AGENDA ITEM DESCRIPTION
On April 3, 2013, the City filed an Eminent Domain action seeking to acquire the necessary right-of-way for the construction and widening of Honeycutt Road as it intersects with SR 347 within the City of Maricopa. An Order for Immediate Possession for the subject property was recorded with the Pinal County Recorder's Office on May 3, 2013. After the recording of the Order for Immediate Possession, the parties obtained appraisals for the subject property and, thereafter, submitted the matter to mediation. During mediation, attended by representative of the City and Maricopa Land Company, LLC, the parties were able to come to a settlement of this matter contingent on Council approval. The terms of the proposed settlement are set forth in the attached Stipulated Final Judgment.
