AGENDA ITEM DESCRIPTION
Legacy on Porter is a commercial development located as shown on Figure-1. This project was recently permitted and is currently under construction. The City’s Engineering design standards require all commercial development provide for their half-street off-site stormwater retention for the 100-year, 2-hour storm in the form of a surface retention basin located on the site. Providing for off-site stormwater retention in a surface retention basin in this case proved difficult since the existing conditions required this property to not only account for off-site stormwater retention adjacent to this property but also account for off-site stormwater retention for the adjacent property, resulting in an undue burden for the developer by requiring a larger surface retention basin than what would have been required otherwise. In this case, the City agreed to allow the developer to retain the off-site stormwater underground allowing more useable property for development. Therefore, an underground retention system has been engineered to provide the requisite off-site stormwater storage on the property. The underground retention system shall be owned and maintained by the property owner(s) in accordance with this Agreement.
