TITLE
A Resolution of the Mayor and City Council of the City of Maricopa approving and adopting a Pre-Annexation Development Agreement and Intergovernmental Agreement between the City of Maricopa the Ak-Chin Indian Community in compliance with A.R.S. §9-500.05. Discussion and Action.

AGENDA ITEM DESCRIPTION
The City of Maricopa (the City) and the Ak-Chin Indian Community (the Community) are partnering in this annexation effort. Prior to the approval by the Bureau of Indian Affairs of the Ak-Chin Fee-to-Trust application, the City and the Community have worked on a plan that allows the City to grow to the south by annexing land on the eastern edge of the Community. The Community agrees to sign the City’s annexation petition. In exchange, the City agrees to support both Ak-Chin Fee-to-Trust applications. For additional details of this joint effort, please see the City of Maricopa Annexation 11-01 and related agreements presented at the August 7, 2012 Council Work Session.

Pre-Annexation and Development Agreement and Intergovernmental Agreement (Ak-Chin Indian Community/City of Maricopa): Specifically, this Pre-Annexation agreement between the City and the Community for the land which will be annexed into the City as part of the larger annexation that reaches south of the fee-to-trust area. This agreement limits changes in land use and protects the land from inclusion in larger City entitlement projects while it is under the jurisdiction of the City. The City is agreeable to these conditions give the limited amount of time this property will remain in the City. This agreement will end once the Fee-to-Trust Application is approved by the Bureau of Indian Affairs. Approval of this agreement is contingent on the signing of Annexation Petition Revised 11-01 by representatives of the Ak-Chin Community and the signing of a Letter of Support for the Ak-Chin Fee-to-Trust Applications by representatives of the City.
