TITLE
The Mayor and City Council shall discuss and possibly take action on approving an Intergovernmental Agreement between the City of Maricopa and the Ak-Chin Indian Community relating to Annexation and Fee-to-Trust Applications. Discussion and Action.
 
AGENDA ITEM DESCRIPTION
The City of Maricopa (the City) and the Ak-Chin Indian Community (the Community) are partnering in this annexation effort.  Prior to the approval by the Bureau of Indian Affairs of the Ak-Chin Fee-to-Trust application, the City and the Community have worked on a plan that allows the City to grow to the south by annexing land on the eastern edge of the Community. In exchange, the City will support both Ak-Chin Fee-to-Trust applications. For additional details of this joint effort, please see the City of Maricopa Annexation 11-01 and related agreements presented at the August 7, 2012 Council Work Session.
 
Intergovernmental Agreement between the City of Maricopa and the Ak-Chin Indian Community: Specifically, the Intergovernmental Agreement between the City and the Community holds long term commitments by both entities. The Community commits to facilitating future expansion along Anderson Road and Peters and Nall Road in the annexation area, which will be crucial to the City to be able to maintain road and utility infrastructure between the two segments of the City. The City commits to protect the Community's agricultural interests near the City and potential cultural resources of the Community as part of the City's future growth. Both parties agree to open communication and mutual support in areas such as transportation, flood control, and public safety.
 
STAFF RECOMMENDATION
Staff recommends that the Mayor and Council approve this IGA with the Ak-Chin as part of our overall Annexation 11-01 efforts and in support of our long term partnership with the Ak-Chin Indian Community.
