TITLE
The Mayor and City Council shall discuss and possibly take action on a request to appoint the Honorable Scott Sulley to serve as the City Magistrate for the term of January 1, 2013 through December 31, 2014 and to enter into a personal services contract specifying the terms and conditions of such service which will be funded from the General fund, City Magistrate, Salaries and Benefits (10011010-51100 through 10011010-52800). Discussion and Action.
AGENDA ITEM DESCRIPTION
The Maricopa City Council has traditionally appointed the sitting Maricopa/Stanfield Justice of the Peace to serve as the City Magistrate, saving the City money by maintaining a collocated court arrangement. The Magistrate's current contract expires on December 31, 2012 and requires Council action to reappoint the Magistrate and extend the term of service.
Section 5-12 (c) of the Maricopa City Code sets forth the maximum term of office for the City Magistrate to be two years; therefore, the contract before Council for consideration is for a term of two years from January 1, 2013 through December 31, 2014.
Section 5-32 (a)(1) of the City Code sets forth the minimum requirements to serve as the City Magistrate, which Mr. Sulley meets or exceeds. The proposed terms for the contract extension are the same as the current contract except for the base salary which was increased from $32,500 per year to $34,125 per year, an increase of 5%.

STAFF RECOMMENDATION
Staff recommends Mayor and City Council appoint the Honorable Scott Sulley to serve as the City Magistrate for the term of January 1, 2013 through December 31, 2014 and approve a personal services contract.
