TITLE

An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona, adopting that certain document filed with the City Clerk and entitled "Floodplain Management Ordinance for City of Maricopa" by reference to amend Section 16.05.010 of the Maricopa City Code and providing for severability and the effective date thereof.  Discussion and Action.

AGENDA ITEM DESCRIPTION

The City has been a participant in the National Flood Insurance Program (NFIP) since 2007.  As a requirement of the NFIP, each community must adopt a Floodplain Management Ordinance that establishes who is responsible for floodplain management.  Section 16.05.010 of the current City Code establishes Pinal County as the Floodplain Administrator making it responsible for all floodplain management activities for the City.

As the Floodplain Manager, Pinal County is responsible for reviewing and approving all floodplain use permits.  The published permit review times for Pinal County ranges from 60 to 90 working days depending on the complexity involved.  By revising this ordinance to assume the responsibility of Floodplain Management, the City is exercising local control over this component of the NFIP.  By keeping reviews in-house, we will be providing a “one-stop-shop” for permitting which will lead to a more streamlined review process.  Concurrently with this item, new Floodplain Use Permit fees will be implemented in accordance with Resolution RES 23-34.

This is a vital step toward being more proactive in managing floodplains in our community to promote public health, safety and general welfare, and to minimize losses due to flooding.  In addition, implementation of this item will also fulfill Objective H2.f.1.7 of the General Plan for the City to become the Floodplain Manager.
