TITLE
The Mayor and City Council shall discuss and possibly take action on approving the Second Amended and Restated Condominium Declaration for Maricopa Grand Professional Village. Discussion and Action.
AGENDA ITEM DESCRIPTION
The City acquired the property where the City Library is located in January 2009. The property is part of the Maricopa Grande Professional Village and was subject to the condominium declaration recorded prior to the City’s purchase. An amendment to the condominium declaration, which corrected some typographical errors and corrected the size of the current units, was recorded in August 2011.
In March 2006, Durkee and Company, LLC purchased the parcels owned by Johnson Bank and was assigned the Declarant rights. Pursuant to those Declarant Rights, Durkee and Company, LLC withdrew a portion of land from the undeveloped Phase 2 from the association. In order to reflect this withdrawal of land and to make the condominium declaration consistent with the current operations of the unit owners, the condominium declaration needs to be amended.

STAFF RECOMMENDATION
Staff recommends that the Mayor and City Council approve the Second Amended and Restated Condominium Declaration for Maricopa Grand Professional Village.
