TITLE
A Resolution of the Mayor and City Council of the City of Maricopa, Arizona, approving and adopting a Pre-Annexation Development Agreement between the City of Maricopa and BNC National Bank in compliance with A.R.S. §9-500.05. Discussion and Action.
 
AGENDA ITEM DESCRIPTION
On July 20, 2011, the City initiated an annexation in the area to the south of the eastern edge of the City limits of the City of Maricopa. City of Maricopa Annexation 11-01 current includes 11 acres of this BNC Bank property. It is the strong desire of representatives of BNC National Bank to see their complete189 acre property annexed into the City of Maricopa. It is important that prior to any annexation, both the City and bank representatives come to an agreement on basic assumptions and stipulations that affect the land, in order to hold these assumptions constant after the completion of the annexations. The stipulations contained in this agreement were initially proposed by City of Maricopa staff and are fully acceptable to BNC National Bank. The provisions of this agreement are limited in scope and apply to the future processing of a General Plan Land Use Amendment for the property. The property is currently zoned General Rural (GR), Industrial (CI-2) within Pinal County. This property is currently included in the City's planning area and designated for employment land uses. Approval of this agreement will not result in any direct cost to the City at this time. Approval of this Pre-Annexation Development Agreement at this time will benefit the City and is consistent with City Council's stated policy to support property owners who wish to join the City through annexation.
 
STAFF RECOMMENDATION
Staff recommends that the Mayor and City Council approve this Pre-Annexation Development Agreement between BNC National Bank and the City of Maricopa.
