TITLE
The Mayor and City Council shall discuss and possibly take action recommending denial to the Arizona Department of Liquor License and Control regarding an application for an interim permit and person transfer submitted by Esther Vidal on behalf of La Roca Night Club at 19599 N. Maricopa Road, Maricopa, Arizona 85138. Discussion and Action.
AGENDA ITEM DESCRIPTION
On April 30, 2013, staff received an application from the Arizona Department of Liquor Licenses and Control for an interim permit and a person transfer for La Roca Night Club. Staff posted the initial public notice on the premises on May 7, 2013 which needed to stay posted for a minimum of 20 days prior to going to the City Council for a recommendation. The notice informs the public that an application for that location has been submitted and anyone wishing to speak in favor or opposition can attend the City Council meeting in which the item will be considered. On May 13, 2013, staff noticed that the public notice was no longer posted on the premises. The applicant was contacted to see if she would still like to have her application considered. The applicant responded on May 29th that she would still like her application considered. Staff reposted the public notice on the premises on May 30th and advised the applicant that it needed to stay on the premises for a minimum of 20 days.
According to the Order of Immediate Possession entered by the Pinal County Superior Court on April 18, 2013, the City of Maricopa currently possesses the property where La Roca Night Club used to operate from. Because it is now City property, staff is recommending that the City Council recommend denying approval of the application at this location.
STAFF RECOMMENDATION
Staff recommends the denial of the liquor license application as requested by the applicant because of its current location. If the applicant has a different location, staff is willing to reconsider its recommendation.
