TITLE

The Mayor and City Council shall discuss and take action on approval of a Presiding Judge Agreement with Stephen McCarville.  Discussion and Action.

 

AGENDA ITEM DESCRIPTION

Last year the City transitioned from a shared court with the Pinal County Justice Court to a separate City Court. During the transition, the city approved an Interim Presiding Judge Agreement to hire Stephen McCarville to lead the transition to a separate City Court.  The City now desires to appoint McCarville as the Presiding Judge for the City Court until December 31, 2025.  McCarville meets the qualifications of judges for the municipal court stated in section 3.80.100 of the Maricopa City Code. He is qualified through education, training and experience to provide the professional services sought by the City and is aware that the Code of Judicial Conduct, Rule 81, Rules of the Arizona Supreme Court, governs the conduct of magistrates as well as Administrative Order No. 83-11 of the Arizona Supreme Court.

 

Hon. Stephen F. McCarville attended Creighton University, Bachelor of Arts, History/Political Science, 1983; and, Creighton University School of Law School, Juris Doctorate Law Degree, 1987. Steve was engaged in the general practice of law with McCarville, Cooper & Vasquez in Casa Grande, Arizona until 2000 and also served as Town Attorney for the Town of Mammoth, from 1990-2000. Steve was appointed as Pro Tempore Juvenile Court Commissioner by Presiding Juvenile Court Judge William O’Neil, in May of 2000, and as Superior Court Judge Pro Tempore by Vice-Chief Justice Charles E. Jones of the Arizona Supreme Court in July 2000. Judge McCarville was elected to his first full term as Pinal County Superior Court Judge, beginning January 2001. Steve served until June 2021, and was the Presiding Judge of the Pinal County Superior Court from 2015-2021. 

 

He is a member of the Pinal County Bar Association; Arizona Bar Association; and, American Bar Association.

 

STAFF RECOMMENDATION

 

 Staff recommends that the Mayor and City Council approve the Presiding Judge Agreement.
