TITLE
The Mayor and City Council shall discuss and possibly take action to enter into an Intergovernmental Agreement between the City of Maricopa and the Pinal County Flood Control District for construction of the Tortosa concrete box culvert drainage improvements, located at the Hartman Road crossing of the canal on the north side of Tortosa.  Discussion and Action.
 
AGENDA ITEM DESCRIPTION
In August of 2012, flooding of the canal on the north side occurred, which affected the Tortosa development.  Since that time, the canal has been in need of repair and maintenance.  The City of Maricopa entered into a development agreement with the new developer of Tortosa N.E. stating the developer will design the improvements to the canal addressing the 100-year flood issues affecting the development.  The agreement states the City of Maricopa will be responsible for the share of construction benefitting the existing Tortosa development, while the developer of Tortosa N.E. will be responsible for the cost of construction benefitting the Tortosa N.E. development.  The City of Maricopa has an opportunity to obtain funding assistance from the Pinal County Flood Control District in an amount not-to-exceed $250,000; the City must enter into an Intergovernmental Agreement (IGA) with the County to obtain the funding.
 
The IGA specifies the funding will be in the form of a reimbursement for the cost of construction for the Hartman Road crossing of the canal.  The crossing will consist of a box culvert large enough to convey a 100-year flood occurrence.  The box culvert construction will not increase flooding potential and is phase one of the overall improvement which, when completed, will take the entire development out of the 100-year floodplain.  The agreement specifies the City must finish construction within two years and provides for an extension up to two additional years, if the County finds the City has been proceeding in good faith to complete the improvements.  The agreement gives the City more than enough time to complete construction.  The improvements are still in design phase and will need to be approved by FEMA before construction can begin.

STAFF RECOMMENDATION
Staff recommends that the Mayor and City Council approve the Intergovernmental Agreement between the City of Maricopa and the Pinal County Flood Control District for the construction of the Tortosa concrete box culvert drainage improvements, located at the Hartman Road crossing of the canal on the north side of the Tortosa development.
