TITLE
A Resolution of the Mayor and City Council of the City of Maricopa, Arizona, exchanging the right-of-way on Taft Avenue adjacent to block 6 and block 3 within the north Maricopa subdivision, Maricopa, Pinal County, Arizona with an approximate 40 foot width of right-of-way on Edison Road adjacent to lots 1-3 of block 6 and lots 2 and 3 of block 3 within the north Maricopa subdivision, Maricopa, Pinal County, Arizona. AGENDA ITEM DESCRIPTION
This is a request to abandon 0.676 acres (60 feet wide by 490.5 feet long) of Taft Avenue right-of-way between Lexington Avenue and Edison Road.  Although the right-of-way exists on a recorded plat, the roadway has never physically existed.  The two adjacent parcels to the east and west have common ownership.  The property owner is dedicating to the City for public use, 40 feet of right-of-way along Edison Road, comprising a total of approximately 0.9 acres across three parcels.  This dedication is included in a Map of Dedication (MOD) for Edison Road which is up for discussion and action on the same meeting. See the Map of Dedication agenda item(MISC 12-060) for an explanation or reason for the dedication.
 
The request was made by the property owner to abandonment the Taft Avenue right-of-way in exchange for the right-of-way for Edison Road.  The City is required to receive compensation for conveying public property to a private property owner and the exchange of property, as in this case, is allowed per A.R.S. ยง28-7203.  
 
Staff contacted the utility providers and received confirmation that no conflicts exist with the utilities if the road were to be abandoned.  Staff has researched the request from the Transportation and Planning perspectives and does not see a need for that portion of Taft Avenue now or in the future.
 
All of the required steps to abandon right-of-way as required in Title 28 of the Arizona State Statutes have been followed.
 
STAFF RECOMMENDATION
Staff recommends approval of the Resolution to abandon the portion of Taft Avenue between Lexington Avenue and Edison Road.
