TITLE
A Resolution of the Mayor and City Council of the City of Maricopa, Arizona authorizing the submission of a grant application to the Gila River Indian Community in support of funding Environmental Concerns Inc. to provide environmental sustainability and recycling projects in the City of Maricopa and act as the designated fiscal agent. Discussion and Action.
 
AGENDA ITEM DESCRIPTION
In February 2010, the City of Maricopa Mayor and City Council passed a grants acquisition and administration policy providing guidelines for the City of Maricopa to consider sponsorship of an application to the State Shared Revenue Programs and is detailed as follows:
 
      Agency guidelines for the City of Maricopa to act as the Fiscal Agent
i.      Agency is a non-profit and /or proof of tax exempt status under the Internal Revenue Code section 501 (c) 3 or similar provision.
ii. The agency must provide an explanation how their proposal aligns with the City of Maricopa Strategic Plan Elements (<http://www.maricopa-az.gov/city_hall/resources/StrategicPlan.pdf>) :
a.      Economic Sustainability
b.      Quality of Life
c.      Transportation
d.      Public Safety
e.      Quality Municipal Services
iii. There must be a benefit to the City of Maricopa community.
 
This is the second time Environmental Concerns Inc. has requested sponsorship from the City of Maricopa.
 
In 2002, Arizona tribes and the Governor concluded negotiations of a new standard form Tribal/State Gaming Compact which was subsequently approved by the Arizona voters. In Section 12 of the Compact, each tribe agreed to contribute a portion of its gaming revenues in exchange for substantial exclusivity covenants by the State. Tribes must deposit 88% of this contributed revenue into the Arizona Benefits Fund. By law, the State must use this contributed revenue to support education, healthcare and other programs that benefit Arizona residents. A tribe may elect to distribute the remaining 12% directly to cities, towns and counties of its choosing.
 
For 2012, the Gila River Indian Community  has elected to award its 12% contribution directly through its 12% grant program. Through the 12% grant program, the Community accepts applications from cities, towns, counties and other organizations seeking funding to support services that benefit the general public.  
 
Applications should request funding only for programs or services that benefit the general public. Within the broad spectrum of services and programs that serve the general public, the Communities give funding preference to applicants whose services address the following priority areas:
 
·      Education
·      Healthcare
·      Public Safety
·      Economic Development
·      Transportation
 
A non-profit or other organization can become eligible if the non-profit can provide:
 
1.      Proof of tax exempt status under Internal Revenue Code section 501 (c) (3) or some other similar provision.
2.   Proof of support and sponsorship from an Arizona city, town or county. Such proof shall be in the form of a resolution adopted showing the government will act as a fiscal agent and accept funding on the non-profit's behalf. The non-profit's application shall bear the signature of an authorized official of the eligible government.
 
Environmental Concerns Inc. is located in Maricopa, Arizona. ECO Inc. is requesting funding for the Community Services Program for court-appointed "youth" and adults and continuation of the Tire Recycling and Household Hazardous Waste Events.
 
These projects are in alignment of the City of Maricopa's Strategic Plan priorities:
Economic Sustainability: A community Tire Recycling and HHW program beautifies the City's planning and development areas, increasing economic development by attracting more businesses into the area, hence creating additional jobs for the residents of Maricopa.
Quality of Life: A community Tire Recycling and HHW program will enhance our neighborhoods and communities and help protect our natural environment and resources. And finally complete initial analysis of options for addressing hazardous waste and recycling issues.
Public Safety : A community Tire Recycling and HHW program will successfully safeguard the City's state of well-being by preventing harm to life, property, the environment, and all who work in, visit, or travel through our community. This project proposal will facilitate the expansion and scope of the Copa Cares program by providing community outreach and education. In addition, the proposed Tire & HHW Recycling Program will foster Code Compliance through compliance initiatives, activities and events.
 
The City of Maricopa would be the fiscal agent for ECO Inc.  Specifically, the Grants Manager would coordinate 1-2 hours a month for the duration of the project (not to exceed 12 months), disbursing grant funding only.  By supporting non-profit agencies, the City is empowering nonprofit leaders to improve the quality of life, build capacity, focus on community solutions and support the sustainability of the non-profit sector.
 
STAFF RECOMMENDATION
Staff recommends passing the resolution of the Mayor and City Council of the City of Maricopa, Arizona authorizing the submission of a grant application to the Gila River Indian Community in support of funding Environmental Concerns Inc. to provide environmental sustainability and recycling projects in the City of Maricopa and act as the designated fiscal agent.
